Pull to Purchase or Rent policy

By completing this purchase you agree to following terms:

1. PURPOSE OF PULL

Garments are released solely for fittings in consideration of purchase or rental.
Garments may not be worn for personal use, events, photoshoots, media, press,
production, or any unauthorized purpose unless purchased in full or rented
pursuant to this Agreement.

Any unauthorized use constitutes Rental or Unauthorized Use under Section 8 and
may result in charges up to the full retail value of the garment(s).

 

2. DEFINITION - STANDARD FITTING

For purposes of this Agreement, a “Standard Fitting” means a brief, private try-on
session conducted solely to assess fit and styling, in a non-public setting, without
photography, filming, press, production use, event attendance, prolonged wear,
tailoring, or any public or commercial exposure.

Any use beyond a Standard Fitting constitutes Rental or Unauthorized Use under
this Agreement.

 

3. CONDITION OF GARMENT(S)

All garments are inspected prior to release and delivered in clean, wearable
condition. Client agrees to inspect the garments immediately upon receipt and
notify The Rareté promptly of any concerns regarding condition.

 

4. CARE & HANDLING

Client agrees to handle all garments with the utmost care. To protect garment
integrity:

  • No outside tailors, seamstresses, dry cleaners, or other service providers may
    alter, clean, or modify garments in any way. If alterations are required, the
    garment must be purchased.
  • No pins, tapes, adhesives, fashion tape, glue, or any items that could puncture,
    stain, stretch, or damage fabric may be used.
  • Tailor clips are available upon request from The Rareté.

If a garment is returned with damage - including holes, stains, stretching, tears,
distortion, broken closures, or unauthorized alterations - Client agrees to purchase
the garment at its full listed retail price.

If damage or soiling occurs, Client must immediately return the garment for
evaluation. No cleaning or repair attempts may be made without prior written
approval.

 

5. LOSS, THEFT, OR IRREPARABLE DAMAGE

In the event of loss, theft, or irreparable damage (as determined solely by The
Rareté), Client is responsible for payment of the full retail value of the garment(s).

 

6. PULL TERMS

Delivery Date: Noted on invoice sent to Client

Return by Date: Noted on invoice sent to Client

The fitting period begins on the Delivery/Pick-Up Date and ends on the Return by
Date listed above. The Return by Date may exceed The Rareté’s standard 72-hour
fitting window at its discretion.

If the garment(s) are rented or deemed rented pursuant to this Agreement, the
approved fitting period (Delivery Date through Return by Date) shall constitute
the full rental term. No additional rental days are permitted unless agreed to in
writing.

Garments must be returned by the Return by Date, defined as:

  • Tendered to and accepted by the carrier with an official carrier scan when
    using the pre-paid return label provided by The Rareté; or
  • Physically returned in person to and accepted by The Rareté.

Returns made after the Return by Date will incur a late fee of 4% of the garment’s
purchase price per piece, per day until the garment(s) are returned and accepted
by The Rareté.

A pre-paid return label will be provided unless otherwise agreed in writing.

 

7. PAYMENT TERMS

Credit Card Authorization: Prior to release of any garment(s), Client shall provide
valid credit card information. The Rareté may place an authorization hold up to
the full retail value per garment and may renew such authorization until the
garment is purchased or returned.

Client authorizes The Rareté to capture any amounts due under this Agreement,
including but not limited to purchase price, Pull Fee, rental fees, late fees,
loss/damage charges, and applicable taxes.

Purchase or Rental Election Deadline: On or before the Return by Date, Client
must notify The Rareté whether the garment(s) will be purchased, rented, or
returned.

 

8. FINAL CHARGES

(a) If Purchased: The Rareté will capture the full purchase price of the garment(s)
(plus applicable taxes). The 10% Pull Fee will be credited toward the purchase
price.

(b) If Returned on Time and in Original Condition (Unused): The Rareté will retain
a non-refundable 10% Pull Fee (calculated on the garment’s purchase price).

(c) If Late, Lost, Damaged, or Used Without Authorization: The Rareté may
capture amounts up to the full retail value of the garment(s), plus late fees (4% per
piece, per day), and any other charges permitted under this Agreement.

(d) If Rented or Used: If Client elects to rent the garment(s), or if the garment(s)
are worn, styled for production, photographed, filmed, publicly or privately
displayed, used for press, editorial, content creation, event attendance, or
otherwise utilized beyond a Standard Fitting, the garment(s) shall be deemed
rented for the duration of the approved fitting period.

The Rareté will apply the 10% Pull Fee toward the applicable 20% Rental Fee
(calculated on the garment’s purchase price), and Client authorizes The Rareté to
capture the remaining balance required to satisfy the full 20% Rental Fee.

The Rental Fee is non-refundable once the garment(s) have been used.

 

9. INSURANCE & CLIENT RESPONSIBILITY

Client assumes full responsibility for the garment(s) from delivery or pick-up until
the garment(s) are:

  • Tendered to and accepted by the carrier with an official scan when using The
    Rareté’s pre-paid return label; or
  • Physically returned in person to and accepted by The Rareté.

If Client elects not to use the pre-paid return label, Client assumes full
responsibility during transit until the garment(s) are physically delivered to and
received by The Rareté. Client must insure such shipment for the full retail value
and provide valid tracking information.

 

10. LIABILITY WAIVER

The Rareté is not responsible for any injury, allergic reaction, or other issues
arising from the use or wear of pulled garments.



11. GOVERNING LAWS & LEGAL FEES

This Agreement shall be governed by the laws of the State of Texas.
In the event of a dispute, the prevailing party shall be entitled to recover
reasonable legal fees and costs.

Failure by The Rareté to enforce any provision of this Agreement shall not
constitute a waiver of future enforcement of that or any other provision.
